Terms and Conditions
This document outlines the general terms and conditions for the use of the Benessere360.org website, which offers wellness consulting services online provided by the owner of the Application.
1. Definitions
To allow for a complete understanding and acceptance of these terms and conditions, the following terms, both singular and plural, will have the meaning indicated below:
Owner: BenEssere360 S.r.l., headquartered at Corso Umberto I 2/A, VAT / Tax Code 02796020028, 314710, fully paid-up share capital €1,000.00, PEC address benessere360@pecditta.com.
Application: The website Benessere360.org.
Products:
Digital products (content and services provided in digital format) sold by the Owner.
Services sold by the Owner.
User: Any individual who accesses and uses the Application.
Consumer User: An adult natural person who enters into a contract for purposes unrelated to their entrepreneurial, commercial, craft, or professional activity, if any.
Conditions: This contract governs the relationships between the Owner and Users and the sale of Products offered by the Owner through the Application.
2. Detailed Information on the Application's Offer
The Application provides Users with Benessere360.org, a platform dedicated to promoting physical and mental wellness through a wide range of services and content. The site offers resources to improve users' overall health, focusing on physical exercises, nutrition, mental health, and stress management.
Main Services Offered:
Personalized Consultations: We offer personalized consultations in nutrition, fitness, and mental wellness. Our experts, including nutritionists, personal trainers, and psychologists, provide tailored plans to meet the specific needs of each user.
Training Programs: We have a vast library of exercise videos and training programs that can be done at home. These programs are designed for various needs such as weight loss, toning, and posture improvement.
Articles and Guides: Benessere360.org provides detailed articles on various health and wellness topics, such as the properties of foods, specific exercises for different body parts, and tips for improving mental wellness.
Mental Wellness Support: We offer resources for stress management and relaxation techniques, such as meditation and mindfulness, to help users maintain mental balance and improve their quality of life.
Marketing Consultations: For wellness professionals, we provide marketing consultations to help them improve their online visibility, attract new clients, and develop effective promotion strategies.
3. Scope of the Conditions
Using the Application implies acceptance of the Conditions by the User. If the User does not intend to accept the Conditions and/or any other notes, legal notices, or information published or referenced herein, they will not be able to use the Application or the related services.
The Conditions may be modified at any time. The applicable Conditions are those in force at the date of transmission of the purchase order or request for the supply of a Product.
Before using the Application, the User is required to read the Conditions carefully and save or print them for future reference.
The Owner reserves the right to change, at its discretion, at any time, the graphic interface of the Application, the Content, their organization, and any other aspect that characterizes the functionality and management of the Application, communicating to the User, where necessary, the relevant instructions.
4. Purchase Through the Application
All Products offered through the Application are described in detail on the respective product pages (quality, characteristics, availability, price, delivery times, additional charges, etc.). Some errors, inaccuracies, or small differences between what is published on the Application and the actual Product may occur. Moreover, any images of the Products are only representative and do not constitute a contractual element.
Purchases of one or more Products through the Application are allowed to Consumer Users.
Purchases are allowed to individuals only if they are of legal age. For minors, any purchase and/or request for the supply of Products through the Application must be reviewed and authorized by parents or guardians.
The offer of Products through the Application constitutes an invitation to offer and the order sent by the User will be considered as a contractual purchase proposal, subject to confirmation and/or acceptance by the Owner as described below. Therefore, the Owner will have, at its discretion, the right to accept or not the User's order without the latter being able to raise objections or complaints for any reason.
The sales contract for the Products is considered concluded with the acceptance by the Owner of the User's purchase proposal. The Owner will accept the User's purchase proposal by sending the order confirmation to the email address indicated by the User, which will include the order date, User data, Product characteristics and availability, price or the method of calculating the price, any additional charges and taxes, delivery and execution times, the methods for exercising the right of withdrawal or its possible exclusion, and the guarantee.
The sales contract for the Products will not be considered effective between the parties in the absence of the foregoing.
If the Product is not available, the Owner will inform the User of the new delivery or supply terms, asking whether they intend to confirm the order or not. It is understood that the contract will be considered concluded concerning the Products accepted by the Owner.
The User undertakes to verify the correctness of the data reported in the order confirmation and to communicate immediately to the Owner any errors and will keep a copy of their order, the related confirmation, and the Conditions.
5. Subscription
The Application offers subscription Products. The characteristics and methods of subscription are detailed in the Application.
To subscribe, the User must follow the procedure indicated in the Application and enter the required data.
Any subscription cost charge will begin on the specified date and at the frequency indicated at the time of subscription.
The subscription is renewed according to the methods and times indicated in the Application.
Users can disable the renewal through the Application or by sending a communication to the email address benessere360@pecditta.com or by calling customer service at +39 3757982431 or by changing the preferences of the payment method used.
6. Prices and Payments
For each Product, the price and VAT, if applicable, are indicated. If the nature of the Product makes it impossible to calculate it in advance, the methods for calculating the price are indicated.
Moreover, all possible taxes and additional charges that may vary in relation to the payment method used will be indicated. If these charges cannot reasonably be calculated in advance, there will be an indication of which expenses will be charged to the User.
The Owner reserves the right to change, at any time, the price of the Products and all additional costs. It is understood that any price changes will not affect contracts already concluded before the change.
The User undertakes to pay the price of the Product within the times and methods indicated in the Application and to communicate all necessary data if requested.
The Application uses third-party tools for payment processing and does not enter into any way in contact with the payment data provided (credit card numbers, cardholder names, passwords, etc.).
If these third-party tools deny payment authorization, the Owner will not be able to provide the Products and cannot be held responsible.
7. Invoicing
The User who wishes to receive an invoice will be asked for invoicing data. The information provided by the User will be used for issuing the invoice, which the User declares and guarantees to be true, indemnifying the Owner for any damage.
8. Supply Methods for Digital Products and Services
The Owner will provide the digital Products, including any digital products provided on a material medium, and/or services to the User in the manner and within the time indicated in the Application and reported in the order confirmation.
If it is not possible to provide the digital Products and services requested within this time, timely notice will be given via email to the User, indicating when it is expected to be able to provide them or the reasons making the supply impossible.
If the User does not intend to accept the new term or the supply has become impossible, they can request a refund of the amount paid, which will be credited promptly in the same payment methods used by the User for the purchase within a maximum of 14 days from the date the Owner became aware of the refund request.
9. Right of Withdrawal of Users from the Purchase of Digital Products and Services
The Consumer User has the right to withdraw without any penalty and without specifying the reason within 14 days from the date of conclusion of the contract by sending a written communication to the email address benessere360@pecditta.com, using the optional withdrawal form provided below or any other written declaration.
If the right of withdrawal is exercised correctly, the Owner will refund the User the payments received in the same payment methods used by the User for the initial transaction, without undue delay and in any event within 14 days from the date the User communicated their intention to withdraw from the contract.
The User acknowledges and agrees to lose the right of withdrawal after downloading or using a digital Product.
The User acknowledges and agrees to lose the right of withdrawal after the complete performance of a service. If the service has not been fully performed and the User wishes to withdraw from the contract, they will still be obliged to pay the Owner an amount proportional to what has been performed up to the time the right of withdrawal was exercised.
The User acknowledges and agrees that withdrawing from a subscribed subscription does not entail the return of amounts related to Products already used or provided.
